Qantas Wellbeing Program - Terms and Conditions

Introduction
The Qantas Wellbeing Program allows Members to Complete Activities and, where applicable, earn Qantas Points.
These Terms and Conditions govern the Qantas Wellbeing Program. They set out the contractual relationship between Qantas and each Member. It is the Member's responsibility to read and understand them.
These Terms and Conditions are effective as at the date specified above and may be amended by Qantas from time to time.
By using the Qantas Wellbeing App, the Member acknowledges that they have read and accepted these Terms and Conditions in addition to the Qantas Wellbeing App Terms of Use.
Definitions
Account means the record of a Member’s Qantas Frequent Flyer membership, which is accessible online at qantas.com
Activity means any activity, challenge, check-up, assessment or promotion as advertised by Qantas for Members to complete in the Qantas Wellbeing App for which Members may earn Qantas Points;
Balance means the total Qantas Points that have been earned in the Qantas Wellbeing App;
Cap has the meaning set out in clause 7;
Completing an Activity (or Completion or Completed) means that a Member has completed an Activity in accordance with these Terms and Conditions and any other conditions advertised at the time of entry into the Activity;
Device means a smartphone or any other device on which the Qantas Wellbeing App may be accessed, as determined by Qantas from time to time;
Eligible Qantas Product means any product that is specified in the Qantas Wellbeing App Earning Table from time to time and that Qantas has not suspended or removed from the Qantas Wellbeing Program;
End Date means, in respect of an Eligible Qantas Product, the applicable date specified in the Qantas Wellbeing App Earning Table from time to time;
Fitness Tracking Device means a health or fitness tracking device that can sense user movement and measure data such as number of steps walked, heart rate and other personal metrics;
Link or Linking means assigning a Tracking Device to the Qantas Wellbeing App and syncing activity data with the Qantas Wellbeing App;
Loss means loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits);
Member means a Qantas Wellbeing Member or a Qantas Eligible Member;
Partner means any association or entity which Qantas has contracted with to provide benefits to Members;
Qantas means Qantas Airways Limited ABN 16 009 661 901;
Qantas Eligible Member means, in respect of an Eligible Qantas Product, the applicable person(s) specified in the Qantas Wellbeing App Earning Table from time to time, provided that they are members of Qantas Frequent Flyer and have downloaded and are using the Qantas Wellbeing App;
Qantas Frequent Flyer means the frequent flyer program known as ‘Qantas Frequent Flyer’, or such other name from time to time, operated by a Qantas Group Company;
Qantas Frequent Flyer Terms and Conditions means the terms and conditions of Qantas Frequent Flyer, as amended from time to time;
Qantas Group means Qantas and its related bodies corporate;
Qantas Points means frequent flyer points awarded to Members in Qantas Frequent Flyer;
Qantas Wellbeing App means the Device application through which Members can take part in the Qantas Wellbeing Program;
Qantas Wellbeing App Terms of Use means the terms of use applicable to users of the Qantas Wellbeing App.
Qantas Wellbeing App Earning Table means the table in Schedule 1 of these Terms and Conditions, as amended from time to time;
Qantas Wellbeing Member means a member of Qantas Frequent Flyer, who joins the Qantas Wellbeing Program by downloading and using the Qantas Wellbeing App but who is not a Qantas Eligible Member;
Qantas Wellbeing Program means the program known as the ‘Qantas Wellbeing Program’, or such other name notified by Qantas from time to time, which is operated by a Qantas Group Company and provides benefits and rewards to Members;
Start Date means, in respect of an Eligible Qantas Product, the applicable date specified in the Qantas Wellbeing App Earning Table from time to time;
Terms and Conditions mean the provisions of this document including the Qantas Wellbeing App Earning Table;
Third Party Products or Services means any products or services that are not in the direct control of Qantas, including Tracking Devices, third party websites, apps, services and other resources;
Updates means software updates to the Qantas Wellbeing App that are released periodically and need to be installed on a Member’s Device.
Eligibility to use Qantas Wellbeing App
To use the Qantas Wellbeing App, a person must:
be a member of Qantas Frequent Flyer;
be 13 years of age or older; and
have downloaded the Qantas Wellbeing App and any Updates on a Device.
If Qantas becomes aware that a person does not meet the criteria in clause 3.1, Qantas may terminate or suspend that person’s access to the Qantas Wellbeing App (permanently or temporarily).
Activities
Number of points available for a challenge
Activities in the Qantas Wellbeing App may be advertised by Qantas to be open for Completion by:
Qantas Wellbeing Members;
Qantas Eligible Members; or
any other person or group of people nominated by Qantas in its absolute discretion from time to time.
The Activities that are open for Completion by a Member may vary based on:
the Device that the Member is using to access the Qantas Wellbeing App;
the version of the Qantas Wellbeing App that the Member has downloaded; and
whether the Member has linked any Fitness Tracking Devices to the Qantas Wellbeing App.
Qantas may, acting reasonably, change the Activities that are open for Completion by Members (including Qantas Eligible Members) with prior notice. Any such change made by Qantas will not impact the Qantas Points earned by the Member before the change.
Qantas Points – General
Earning Qantas Points
A Member may earn Qantas Points by Completing an Activity.
Qantas Points earned by a Member for the Completion of an Activity will be:
deemed to be earned upon Completion of the Activity; and
credited to the Member’s Account within 14 days of Completion of the Activity.
Members can track how many Qantas Points have been credited to their Account for the Completion of Activities by logging into their Account on qantas.com or via the Qantas Wellbeing App.
Number of Qantas Points available for an Activity
The number of Qantas Points available to be earned for the Completion of an Activity will be the number communicated by Qantas at the time of entry into the Activity.
The number of Qantas Points available to be earned by a Member for the Completion of an Activity may vary based on:
the Device that the Member is using to access the Qantas Wellbeing App;
the version of the Qantas Wellbeing App that the Member has downloaded; and
whether the Member has linked any Fitness Tracking Devices to the Qantas Wellbeing App.
Qantas may, acting reasonably, change the Qantas Points available to be earned or accrued for an Activity with prior notice. Any such change made by Qantas will not impact the Qantas Points earned by successfully Completing an Activity that commenced before the change.
Qantas may cancel or deduct any Qantas Points that have been awarded or recorded in error.
Qantas Points – Earn Rates
Rate at which Qantas Points may be earned
Subject to clause 6.8, a Qantas Eligible Member will earn Qantas Points for Completing certain Activities at a higher rate than Qantas Wellbeing Members, as specified in the Qantas Wellbeing App Earning Table from time to time. For the avoidance of doubt, Qantas Eligible Members may earn Qantas Points for completing an Activity at different rates to one another, depending on the Eligible Qantas Product(s) that they hold.
Qantas may, acting reasonably, change the rates at which Members (including Qantas Eligible Members) earn Qantas Points with prior notice. Any such change made by Qantas will not impact the Qantas Points earned by a Member through the Completion of Activities before the change.
Eligible Qantas Products
Qantas may make the following changes to the Qantas Wellbeing Program, acting reasonably at any time and with prior notice:
classify a product as an Eligible Qantas Product; or
suspend or remove a product from being an Eligible Qantas Product (permanently or temporarily).
Any change made by Qantas under clause 6.3 will not impact the Qantas Points earned before the change.
If an Eligible Qantas Product is suspended or removed from being an Eligible Qantas Product, a Qantas Eligible Member will not earn Qantas Points in respect of that product while it is suspended or removed.
Qantas may, acting reasonably, restrict or limit access to the Qantas Wellbeing Program and/or Qantas Wellbeing App to only Qantas Eligible Members with prior notice.
Qantas Wellbeing Members and Qantas Eligible Members
If Qantas is notified that a Qantas Wellbeing Member has become a Qantas Eligible Member, the Member will begin to earn Qantas Points for the Completion of each Activity at the applicable earn rate of a Qantas Eligible Member from the Start Date until the End Date of the relevant Eligible Qantas Product.
Without limiting any other provision of these Terms and Conditions, from time to time, Qantas may, permit a Qantas Wellbeing Member to earn Qantas Points for Completing an Activity at the same rate at which a Qantas Eligible Member earns Qantas Points. In such cases, Qantas may, acting reasonably, impose limitations or conditions in connection with the Member’s ability to earn Qantas Points, including (but not limited to):
limiting the number of Qantas Points that can be earned by that Member in any given period;
limiting the rate by which that Member can earn Qantas Points (which, for the avoidance of doubt, can be different to the rate at which a Qantas Eligible Member can earn Qantas Points for Completing the same Activity); or
by notice, extending or terminating the applicable period in which that Member can earn Qantas Points without the requirement to become a Qantas Eligible Member.
Caps on earning Qantas Points with the Qantas Wellbeing App
Qantas may acting reasonably, with notice (and on any conditions) impose caps (Caps) on:
the total number of Qantas Points that can be earned for each Eligible Qantas Product with the Qantas Wellbeing App; and
the total number of Qantas Points that a Qantas Eligible Member can earn in respect of any or several Eligible Qantas Product(s) with the Qantas Wellbeing App.
Qantas can change any Cap at any time acting reasonably, with notice. This will not impact any Qantas Points earned before the change.
Unless expressly stated otherwise, any Cap applicable to a Qantas Eligible Member or an Eligible Qantas Product, as the case may be, will override the number of Qantas Points offered for Completion of an Activity.
Fitness Tracking Devices and other Third Party Products and Services
Members must Link a compatible Fitness Tracking Device to the Qantas Wellbeing App in order to record their physical activity, where required to Complete an Activity and earn any associated Qantas Points.
If a Member has Linked more than one Fitness Tracking Device to the Qantas Wellbeing App at any given time, the data used to assess progress towards an Activity will be only that Linked from the Fitness Tracking Device that measured highest for that Activity.
Qantas is not responsible for any Third Party Products or Services, including for the accuracy, reliability, effectiveness, or correct use of information Members receive through Third Party Products or Services, or for any associated costs, all of which are the responsibility of the Member.
Members are responsible for reading and agreeing to any terms and conditions that apply to the use of Third Party Products or Services.
Advertised offers
Qantas may advertise, via the Qantas Wellbeing Program or Qantas Wellbeing App, offers under which Members may earn Qantas Points by acquiring or using eligible Qantas Group or Partner products or services. The terms and conditions that apply to such offers will be notified to Members.
Qantas Frequent Flyer Terms and Conditions
Membership of Qantas Frequent Flyer, and the earning and redeeming of Qantas Points, will be governed by the Qantas Frequent Flyer Terms and Conditions and any other conditions notified to Members from time to time.
General
Interpretation
In these Terms and Conditions, unless the contrary intention appears:
the singular includes the plural and vice versa;
dollars or $ means Australian dollars;
unless otherwise stated, all dollar amounts include any applicable GST;
dates or times are Universal Time Code (or GMT) dates or times;
a reference to 'include' or 'including' means 'including but not limited to';
a definition of a capitalised word applies to all grammatical forms of the capitalised word. For example, the definition of “Completing” applies to Complete, Completes, Completed and Completion.
Personal Information
Members consent to Qantas collecting, using and disclosing any personal information including health and wellbeing and Activity information submitted by the Member through joining or participating in the Qantas Wellbeing Program or collected by Qantas through the Fitness Tracking Device or the Qantas Wellbeing App, solely for the purpose of providing or improving user-facing features of the Qantas Wellbeing Program or the Qantas Wellbeing App and otherwise in accordance with the Qantas Privacy Policy. Notwithstanding anything to the contrary set forth in the Qantas Privacy Policy, Qantas will not collect, use or disclose personal information including health and wellbeing information for any of the following purposes: advertising (targeted, retargeted, user, personalised, interest-based or otherwise); selling or providing it to data brokers or information resellers; lending or determining credit-worthiness; creating databases or training AI models.
When a Member uses the Qantas Wellbeing App, they may choose to provide Qantas the names, phone numbers and email addresses of the people in their Device or Facebook address book (Contacts). If a Member does this, they confirm they are authorised to provide Qantas such information. Qantas will only use such information to inform the Member whether each of their Contacts is a Member, and to allow the Member to invite their Contacts to download and connect with the Member via the Qantas Wellbeing App.
Subject to the limitations set forth in clause 11.2., Qantas will manage all personal information in accordance with applicable privacy laws and the Qantas Privacy Policy available at Qantas.com.
Subject to the limitations set forth in clause 11.2., Qantas may use and disclose Members’ personal information (but not any sensitive health information) to Partners and any other person (including related bodies corporate, agents and contractors) for the purposes of:
Qantas or any of its related bodies corporate, providing products or services, including the awarding of Qantas points to Members;
Qantas or any of its related bodies corporate improving customer service, including by means of research, marketing, product development and planning;
Qantas marketing its products or services or the products or services of third parties; and
assisting any third party providing services to Qantas, any of its related bodies corporate or Members in connection with the administration of Eligible Qantas Products or Qantas Frequent Flyer.
If all or any part of the requested information is not provided by the Member or if the Member does not give the consent referred to above, the services provided to that Member by Qantas may be affected.
Members may at any time request Qantas to delete their personal information via the App or by emailing help@qantaswellbeing.com.
This clause survives the termination of these Terms and Conditions and the termination or suspension of any Eligible Qantas Product.
Limitation of Liability
Qantas acknowledges that certain laws imply terms, conditions or warranties into contracts for the supply of goods or services that cannot be excluded. For example, for consumers, services come with non-excludable warranties under consumer protection legislation that they will be provided with due care and skill and be reasonably fit for their purpose. This Limitation of Liability clause is not intended to exclude or restrict the application of such laws.
Subject to any applicable consumer protection legislation, the Qantas Group and any of its officers, employees, consultants, contractors or agents (‘Representatives’) are not liable for any Loss arising under or in connection with these Terms and Conditions or the Qantas Wellbeing Program or Qantas Frequent Flyer, including, without limitation, any changes to the Terms and Conditions, changes to the Qantas Wellbeing Program or changes to Qantas Frequent Flyer, except to the extent that such Loss is caused or contributed to by the gross negligence or wilful misconduct by the Qantas Group or its Representatives.
The Qantas Wellbeing Program is not intended to diagnose, treat, cure, or prevent any disease. If you have a medical or heart condition, consult your doctor before participating in the Qantas Wellbeing Program (including by using the Qantas Wellbeing App), engaging in an exercise program or changing your diet. If you experience a medical emergency, stop participating in the Qantas Wellbeing Program (including by using the Qantas Wellbeing App) and consult with a medical professional. Qantas is not responsible for any health problems that may result from training programs, consultations, products, or events you learn about through the Qantas Wellbeing Program. If you engage in any exercise program you receive or learn about through the Qantas Wellbeing Program you agree that you do so at your own risk and are voluntarily participating in these activities.
Benefit of third party
Qantas holds the rights under these Terms and Conditions expressed to be for the Qantas Group as agent of and trustee for every member of the Qantas Group, and every member of the Qantas Group must be treated to this extent as a party to these Terms and Conditions.
Severability
If any provision in these Terms and Conditions is unenforceable, illegal or void or makes these Terms and Conditions or any part of them unenforceable, illegal or void, then that provision is severed and the rest of these Terms and Conditions remain in force.
Governing Law
The law of New South Wales governs these Terms and Conditions.
The parties submit to the exclusive jurisdiction of the courts of New South Wales.
Alerts and notifications
By participating in the Qantas Wellbeing Program (including by downloading and using the Qantas Wellbeing App), Members agree to receiving notifications, text messages, alerts, and emails. Members can control receipt of non-service related communications from their Account and Qantas Wellbeing App settings.
Schedule 1 - Qantas Wellbeing App Earning Table
For Qantas Travel Insurance policies purchased before 19 July 2023, please see the Qantas Wellbeing App earning table below. For Qantas Travel Insurance policies purchased on 19 July 2023 onwards, please note that these will not be eligible for these earn rates.
^ Unless otherwise specified, the earn rates set out in this table do not apply to short term promotions and special offers.
# Unless otherwise specified, where a person is a Qantas Eligible Member in respect of multiple Eligible Qantas Products, the earn rates for the products are not cumulative, and the highest of the earn rates for each challenge will apply.
^ Where a person is a Qantas Eligible Member in respect of multiple Eligible Qantas Products (excluding Qantas Travel Insurance policies) that have an earn rate of 10x for the Daily/Weekly Activity Challenges, the person’s earn rate for those challenges will be 20x.
~ Where a person is a Qantas Eligible Member in respect of multiple Eligible Qantas Products (excluding Qantas Travel Insurance policies) that have an earn rate of 10x for the Sleep Health Challenge, the person’s earn rate for that challenge will be 20x.
